Who Issues Driving Licenses?

Drivers who have legally changed their names must submit proof, such as a birth or marriage certificate, of their altered identities and documents verifying their date and place of birth. Federal

The federal government does not issue driving licenses directly, although they set criteria and regulations for Commercial Driver Licenses issued by individual states. Furthermore, military bases offer Military Driver Licenses valid only within their boundaries rather than public roadways.

New York offers both standard and enhanced driver licenses regardless of immigration status; an enhanced one, which establishes citizenship alongside driving privileges, requires either a U.S. passport or birth certificate with an “Enhanced” designation and features a star in one corner to indicate its citizenship-establishing nature; additionally, these documents are accepted by WHTI for crossings from Canada, Mexico or the Caribbean back into the U.S. Motorcycle and commercial driver’s licenses may also be issued as enhanced forms.

The federal Real ID Act sets standards for identity documents that meet official purposes, such as entering federal buildings or boarding airplanes. Non-Real ID cards become less useful for these official tasks due to needing to be more secure. Homeland Security enforces it; states can opt in or out, though if they choose not to meet these standards, their licenses and I.D. cards must display “Not for Federal Purposes.”

State DMVs have the legal authority to refuse to give driver records to immigration officials unless specifically required by court order or subpoena. New York allows all drivers, regardless of immigration status, to obtain a standard non-restricted driver’s license or learner permit. In that case, they must present either their original U.S. going record or certificate of driving experience and pass both the CDL skills test and a written knowledge exam, as well as pass a medical examination and vision screening for CDL vision screening purposes. Additional restrictions include no driving between 11 pm and 5 am; three passengers under 19 (except family) cannot travel together at once, and the requirement to wear seat belts at all times when in commercial use.

International

An international driving permit (IDP) is a translation of your driver’s license that enables legal driving in foreign countries. Recognized in over 175 nations, to apply for one, you need your valid U.S. driver’s license and $20 and two passport-sized photos; your permit will be instantly issued at an AAA branch, or it can take 10-15 business days to arrive via mail.

Most states and territories, such as New York, do not mandate that visitors obtain an IDP to drive in their jurisdictions; however, it is strongly advised for drivers whose native licenses do not contain English text. Some rental car companies may prohibit you from renting vehicles without one, and some insurance policies don’t cover foreign drivers.

Before traveling abroad, those without the ability to obtain an International Driver’s Permit (IDP) should get an official translation of their domestic driver’s license.
